Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is intended to be provided on a weekly basis.


LEGISLATION CHANGES

Amendments to Australian Accounting Standards - Covid-19-Related Rent Concessions 

  • Amends Australian Accounting Standard AASB 16 Leases (February 2016).

CASA EX97/20 - Aircraft Engineer Licence and Rating Training and Qualification (Extension of Time Due to COVID-19) Exemption 2020 

  • Provides temporary relief for aircraft engineer licence and ratings candidates whose training, examination and qualification have been affected by the Government’s response to control the spread of COVID-19.

Coronavirus Economic Response Package (Payments and Benefits) Amendment Rules (No. 5) 2020 

  • Revises the rules in the JobKeeper scheme so that entities that are approved providers of child care services are not entitled to JobKeeper payments for certain employees or for a business participant.

Part 66 Manual of Standards Amendment Instrument 2020 (No. 1) 

  • Makes amendments to the Part 66 Manual of Standards that are consequential to amendments of Part 66 of the Civil Aviation Safety Regulations 1998, Continuing airworthiness - aircraft engineer licences and ratings, made by the Civil Aviation Safety Amendment (Part 66 Transition Extension) Regulations 2020.

Treasury Laws Amendment (2020 Measures No. 3) Act 2020

  • Amends the law relating to taxation, international monetary agreements and the cash flow boost, and for related purposes.


Public Health (COVID-19 Interstate Hotspots) Emergency Direction 2020 (No 3)

  • Directs affected persons to quarantine following travel to and from COVID-19 hotspots in Victoria.

Public Health (Emergency) Declaration Further Extension 2020 (No 10) 

  • Further extends the period during which the Public Health (Emergency) Declaration 2020 (No 1) is in force for a period of 45 days.

Public Health (Returned Travellers) Emergency Direction 2020 (No 6) 

  • Revokes the Public Health (Returned Travellers) Emergency Direction 2020 and the Public Health (Returned Travellers) Emergency Direction 2020 (No 5).

Public Health Amendment (COVID-19 Spitting and Coughing) Regulation (No 2) 2020 

  • Allows for the issue of penalty notices for an offence against section 10 of the Public Health Act 2010 involving intentionally spitting or coughing on a public official or other worker in a way that is likely to cause fear about the spread of COVID-19.

Public Health (COVID-19 Interstate Hotspots) Order 2020 

  • Gives a number of Ministerial directions in respect of persons who have been in certain COVID-19 hotspots in Victoria within the previous 14 days.

Public Health (COVID-19 Interstate Hotspots) Amendment Order 2020 

  • Adds two additional postcodes to the list in Schedule 1 to the Public Health (COVID19 Interstate Hotspots) Order 2020.

Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 4) 2020 

  • Revokes and remakes the Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 3) 2020 to ease certain restrictions.

Public Health (COVID-19 Spitting and Coughing) Order (No 2) 2020 

  • Gives a Ministerial direction about intentionally spitting at or coughing on public officials or other workers in a way that is reasonably likely to cause fear about the spread of COVID-19.

Retail and Other Commercial Leases (COVID-19) Amendment Regulation 2020

  • Clarified that lessors are prohibited from taking certain action in respect of commercial leases to which impacted lessees are party, requires impacted lessees to give specific information to lessors, and clarified the application of certain clauses to impacted lessees.


State Penalties Enforcement Amendment Regulation (No. 1) 2020

  • Amends the State Penalties Enforcement Regulation to increase the infringement notice fine for breaching the Border Restrictions Public Health Directions to 30 penalty units for an individual ($4,004).

Youth Justice (COVID-19 Emergency Response) Regulation 2020

  • Ensures that restorative justice conference agreements made during the COVID-19 health emergency period remain compliant with the Youth Justice Act 1992.


COVID-19 Emergency Response Residential Tenancies Expiry Notice 2020

  • Specifies that Section 8(1)(c) of Part 2 of the Covid-19 Emergency Response Act 2020 will expire on 2 July 2020.


Direction Under Section 16 of the Public Health Act 1997 (Residential Aged Care Facilities - No. 8)

  • Directs persons not to enter or remain on the premises of a residential aged care facility except in certain circumstances.

Land Tax Amendment Act 2020

  • Allows for an exemption from land tax in the 2020-21 financial year for commercial property owners who have been adversely financially impacted.

Notice Under Section 13 of the COVID-19 Emergency (Miscellaneous Provisions) Act 2020

  • Extends by 6 months the period by which an independent review must be carried out under Section 151(5) of the Gaming Control Act 1993.

Notice Under Section 22 of the Covid-19 Disease Emergency (Miscellaneous Provisions) Act 2020

  • Prohibits termination of a residential tenancy agreement lease, or the increase of ret payable under such a lease, in certain circumstances.

Residential Tenancy (Extension of Emergency Period) Order 2020

  • Extends the emergency period for the purposes of the Residential Tenancy Act 1997 until 30 September 2020.

Residential Tenancy (Shorter Period) Notice 2020

  • Determines the period beginning on the COVID-19 emergency day and ending on 30 June 2020 to be a shorter period for the purposes of Section 56 of the Residential Tenancy Act 1997.


Area Directions (No 2) 

  • Identifies areas which have a higher prevalence of, or risk of exposure to, COVID-19 and which are subject to specific directions to protect public health.

Care Facilities Directions (No 6) 

  • Provides for restricted access to care facilities to limit the spread of COVID-19 within a particularly vulnerable population.

Detention Directions - 9 Pampas Street North Melbourne 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 12 Holland Court Flemington 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 12 Sutton Street North Melbourne 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 33 Alfred Street North Melbourne 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 76 Canning Street North Melbourne 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 120 Racecourse Road Flemington 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 126 Racecourse Road Flemington

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 130 Racecourse Road Flemington 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Detention Directions - 159 Melrose Street North Melbourne 

  • Requires persons who ordinarily reside in a detention location to limit their interactions with others by restricting the circumstances in which they may leave the residence.

Diagnosed Persons and Close Contacts Directions (No 4)

  • Requires persons diagnosed with COVID-19, and persons living or in close contact with a diagnosed person, to self-isolate.

Hospital Visitor Directions (No 7) 

  • Prohibits non-essential visits to hospitals to limit the spread of COVID-19.

Restricted Activity Directions (No 11) 

  • Restricts the operation of certain businesses and undertakings to limit the spread of COVID-19.

Restricted Activity Directions (Restricted Postcodes) 

  • Restricts the operation of certain businesses and undertakings in certain restricted postcodes to limit the spread of COVID-19.

Stay at Home Directions (Restricted Postcodes) 

  • Requires everyone who resides in certain restricted postcodes to limit their interactions with others by restricting when they may leave the residence and restricting gatherings.
Stay Safe Directions (No 3) 
  • Requires persons who reside in Victoria, other than in certain restricted postcodes, to limit their interactions with others by restricting gathering and the return to workplaces


Extension of Declaration (No. 2) of Public Health State of Emergency 

  • Extends the public health state of emergency declaration which came into effect on 23 March for 14 days.

Mining Amendment (COVID-19 Response) Regulations 2020 

  • Amends the Mining Regulations 1981 to allow exemptions from certain expenditure requirements in relation to the COVID-19 pandemic.


COVID-19 Public Health Response (Maritime Border) Order 2020 

  • Prevents, and limits the risk of, an outbreak, or the spread, of COVID-19 by restricting which ships may arrive in New Zealand and putting in place isolation or quarantine requirements for people who arrive in New Zealand by sea.

Special Direction - Waiver of Certain Requirements for the Making of a Transit Visa Application During COVID-19 Travel Restrictions 

  • Facilitates the application for a transit visa for nationals of countries who must apply for and obtain a transit visa to travel to and be in New Zealand as a transit passenger by reducing the application requirements.

Special Direction - Waiver of the Requirement for a Transit Visa to Travel to and be in New Zealand as a Transit Passenger During COVID-19 Travel Restrictions

  • Allows a citizen of any country who is not a person to whom a transit visa waiver applies, travelling from certain Pacific countries, to travel to and be in New Zealand as a transit passenger on the way back to their home country
